Terms & Conditions for LexiLock

These Terms apply to the use of the mobile app LexiLock (iOS and Android).

2. Scope of Application

(1) These Terms govern the provision and use of the LexiLock app and – insofar as offered – paid premium features in the form of in-app subscriptions.

(2) Deviating conditions of users do not apply unless we expressly agree to them.

3. Service Description

(1) LexiLock integrates vocabulary training into everyday life by allowing a short vocabulary query before opening certain apps.

(2) Free features (Free): Basic features for vocabulary quizzes and use of word decks.

(3) Premium features (Subscription): Extended features (e.g. additional content/decks or premium functionality, depending on the current app version). The exact scope of functionality is described in the app description in the respective app store and within the app.

(4) The vocabulary query as a core function is a central component of the app. Features related to ScreenTime/app blocking may vary depending on the operating system version, device settings, or Apple/Google policies.

4. Prerequisites / Use of ScreenTime (iOS) and Comparable System Features (Android)

(1) For blocking/focus features, LexiLock can use system features such as ScreenTime or corresponding OS mechanisms. These may require separate activation/permission by the user.

(2) We point out that the technical implementation and availability of such system features are not completely within our control (e.g. changes due to iOS/Android updates).

(3) The app can generally be used without the blocking function enabled, provided that the respective app version allows this.

5. Usage Rights / Permitted Use

(1) We grant the user a simple, non-transferable, revocable right to use LexiLock for private purposes on their own devices.

(2) Commercial use (e.g. resale, rental, use as part of a paid service) is prohibited unless we expressly agree to it.

(3) The user must not misuse the app, in particular not bypass technical protection measures, decompile the app (insofar as not legally required), manipulate it, or use it to harm third parties.

6. Contract Formation, Prices and In-App Subscriptions

(1) LexiLock is a freemium product: The basic version is free, premium features are available through monthly and annual subscriptions.

(2) Contract formation and billing take place exclusively via the Apple App Store or Google Play Store. The terms of the respective store apply additionally.

(3) The current prices and terms are displayed in the app and in the store. A trial period is not currently offered.

7. Term, Renewal and Cancellation (Subscriptions)

(1) Subscriptions run monthly or annually as selected and renew automatically unless cancelled in a timely manner via the respective store.

(2) Cancellation takes place exclusively via the subscription management of the Apple App Store or Google Play Store.

(3) After cancellation, Premium remains active until the end of the already paid billing period, unless the store provides otherwise.

8. Right of Withdrawal for Digital Content / Services

(1) For consumers (any natural person acting for purposes that are predominantly neither commercial nor self-employed professional activity) statutory withdrawal rights apply.

(2) In the case of digital content and digital services, the right of withdrawal may lapse under certain circumstances if performance has begun.

Notice for In-App Purchases:
Since the purchase takes place via Apple/Google, withdrawal, refund and processing are usually handled according to the rules of the respective store. Please check the notices and processes in the respective store for details.

Expiration of Right of Withdrawal (typical case):
The right of withdrawal may lapse if

  • we have begun to perform the contract after the user has explicitly agreed that we may begin before the withdrawal period expires, and
  • the user has confirmed that they are aware that this will result in the loss of their right of withdrawal.

The technical obtaining/implementation of this consent takes place within the framework of the store mechanisms or the in-app purchase flow.

9. Updates, Changes and Availability

(1) We develop LexiLock further and may adapt, change or develop features, provided this is reasonable for the user and does not substantially impair the purpose of the contract.

(2) We strive for high availability. However, constant, error-free availability cannot be guaranteed (e.g. maintenance, failures, OS updates, store policies).

(3) Content/decks may be updated, supplemented or replaced to a reasonable extent.

10. Warranty

Statutory warranty rights apply. For free services, our liability/obligation to pay for damages may be limited to the extent permitted by law.

11. Liability

(1) We are liable without limitation for intent and gross negligence as well as under mandatory statutory provisions (e.g. product liability) and for violations of life, body or health.

(2) In the event of slight negligent breach of essential contractual obligations (cardinal duties), our liability is limited in amount to the damage typically foreseeable.

(3) Beyond that, liability is excluded to the extent permitted by law.

(4) LexiLock is a learning and focus tool. A certain learning or behavioral success is not guaranteed.

12. Age Requirement

(1) LexiLock is intended for users aged 13 and above.

(2) To the extent that applicable law requires parental consent, use is only permitted with appropriate consent.

13. Data Protection

14. Final Provisions: Applicable Law and Jurisdiction

(1) German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) If the user is a consumer, this choice of law applies only insofar as it does not deprive the user of the protection afforded by the mandatory provisions of the law of the state in which the consumer has their habitual residence.

(3) For users who are merchants, legal entities under public law or public funds, the court of competent jurisdiction is – insofar as permitted – Emsdetten. For consumers, the statutory jurisdiction applies.
